Cross-border distance selling of tobacco products

All retailers who want to sell tobacco products across the border (e.g. via online sales) must register with the Danish Business Authority - department of Market Surveillance and Technical Safety (formerly Danish Safety Technology Authority).

Distance sales

Distance sales across borders must be registered because certain EU countries prohibit the distance sale of tobacco products, electronic cigarettes, and more. Retail outlets engaging in cross-border distance sales may not supply goods to consumers in those Member States where such sales are prohibited.
 

This applies both if you are a retailer in Denmark and wish to sell to another EU/EEA country, and if you are a retailer in another EU/EEA country and wish to sell to Denmark. In these cases, you must register in the EU/EEA country where the consumer is located. 

If you only wish to sell the product within the Danish borders, it is not considered distance selling. In this case, the product must be reported/notified to the Danish Business Authority, but you do not need to register as a retailer.

How to register

The registration to the Danish Business Authority must be made through an official form. You can find the form on Virk.dk.

You must fill in information about:

  • Name, address, etc. of the company
  • Date of when the place of retail sale begins cross-frontier distance selling.
  • Address of the website(s)
  • Other relevant information about the website.

If the information is changed, you must immediately inform the Danish Business Authority about this.

Marketing may not begin before the Danish Business Authority has confirmed that the registration has taken place.

The Danish Business Authority monitors websites that market to Danish consumers via distance selling.

Retail outlet outside the EU

If the retail outlet is established outside the EU, you must register with the competent authorities in the EU country where the consumers are located. Competent authorities are usually a Ministry of Health or similar entities. The Danish Business Authority cannot assist in identifying registration sites with foreign competent authorities.

Reporting products to the Danish Business Authority
Tobacco products may only be marketed in Denmark if they are reported to the Danish Business Authority. The reporting requirement also applies to products marketed in Denmark via distance selling.
