Cross-border distance selling

This applies both if you are a retailer in Denmark and want to sell to another EU/EEA country, and if you are a retailer in another EU/EEA country and want to sell to Denmark. You must register in the EU/EEA country where the consumer is.

Registration of manufacturing, marketing etc of e-cigarettes
Anyone who manufactures, stores or markets electronic cigarettes or refill containers with and without nicotine must register themselves and places with the Danish Safety Technology Authority prior to marketing.

You must fill in information about:

• Name, address, etc. of the company
• Date when the place of retail sale begins cross-frontier distance selling
• Address of the website(s)
• Other relevant information about the website, if any

If the information is changed, you must immediately inform the Danish Safety Technology Authority about this.

Marketing may not begin before the Danish Safety Technology Authority has confirmed that the registration has taken place.

The Danish Safety Technology Authority regularly publishes and updates a list of registered retailers on the Danish Safety Technology Authority’s website.

If the place of retail sale has been established outside the EU, you must register with the competent authorities in the EU-country where the consumers are located. Often the competent authorities are a Ministry of Health or the like. The Danish Safety Technology Authority can assist in appointing registration sites from foreign competent authorities.

The cause of registration is that certain EU-countries ban cross-border distance selling of tobacco, electronic cigarettes, etc. Places of retail sale, which run cross-border distance selling, must not deliver goods to consumers in the Member States where such a sale is forbidden.
