The demands ensure that consumers and their surroundings are protected against contact with the nicotine-containing liquid. The nicotine-containing liquid can pose an acute risk of poisoning if it gets in contact with the skin or if you accidentally drink it. This applies in particular to children. The technical demands also ensure that the electronic cigarette products do not provide disproportionately high doses of nicotine.
Demands on child and tamper protection
You are only allowed to sell refillable electronic cigarettes and refillable containers with nicotine, which are equipped with a special child and tamper protection.
The child and tamper protection must meet the following demands:
If you use a system, which has a flow control device, the refillable container must be equipped with a safety fixed nozzle of at least 9 mm, which is narrower than or can easily fit into the reservoir of the electronic cigarette. The nozzle must have a flow control device which does not emit more than 20 drops of liquid per minute.
If you use a docking-system, it can only release liquid to the reservoir when the electronic cigarette and refillable container are connected. Read more about specific provisions here: § 9 of Executive Order 499.
Demands for the user manual
The direction for use for all refillable electronic cigarettes and refillable containers with nicotine must include appropriate instructions about refill – including diagrams.
If you use a system, which has a flow control device, the instruction for use must state the length of the nozzle or the width of the opening of the reservoir so that the consumer him-/herself can see if the electronic cigarette and refillable container fit together.
If you use a docking-system, the direction for use must state which electronic cigarette and refillable container the system fits into.
